The Legal Framework: PPPFA and Regulations
The Preferential Procurement Policy Framework Act 5 of 2000 (PPPFA) and its Preferential Procurement Regulations give legal effect to B-BBEE-based preference points in government procurement. The regulations establish two scoring systems based on contract value: the 80/20 system for contracts between R30 000 and R50 million, and the 90/10 system for contracts above R50 million.
Under both systems, price accounts for the majority of points (80 or 90), with the remaining 20 or 10 points allocated for B-BBEE status. A tenderer's B-BBEE preference points are determined by their certified B-BBEE contributor level.

Under the 80/20 system (contracts R30 000 to R50 million), preference points are:

Prequalification Criteria: When B-BBEE Is a Threshold
Beyond scoring points, organs of state may set prequalification criteria that make a minimum B-BBEE level a mandatory threshold — not just a scoring factor. Regulation 4 of the Preferential Procurement Regulations allows an organ of state to apply prequalification criteria to advance certain designated groups, small businesses, or sub-contracting requirements.
Common prequalification criteria include: minimum B-BBEE Level 2 or 3 for large infrastructure contracts, minimum Level 4 for general services contracts, or requirements that a percentage of the contract value be subcontracted to EMEs or QSEs that are at least 51% black-owned.
Set-Asides for Small Businesses
Regulation 5 allows organs of state to designate certain tender categories as set-asides exclusively for EMEs or QSEs. This means only businesses in those size categories may bid, giving small black-owned businesses a protected procurement lane in sectors where they would otherwise be outcompeted by large corporations.
Set-asides are most commonly applied to maintenance, cleaning, security, catering, and other service contracts below R10 million in value.

Does a sole proprietor qualify for preference points?
Yes. Sole proprietors are subject to B-BBEE measurement. An African, Coloured, or Indian South African citizen who is a sole proprietor may qualify as an automatic Level 1 EME if their turnover is below R10 million and the affidavit confirms 100% black ownership (themselves).
Can state-owned enterprises set their own B-BBEE procurement requirements?
