1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of www.tenderforce.co.za (the "Site") and any related tools, calculators, and services provided by TenderForce ("we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Description of Service
TenderForce provides South African government tender listings, compliance guides, B-BBEE and CIDB calculators, AI-assisted tender tools, and educational content to help businesses find and prepare for government procurement opportunities. Tender information is aggregated from publicly available sources and is provided for informational purposes only.
3. No Guarantee of Tender Outcomes
TenderForce is an information and tooling platform. We do not represent, guarantee, or warrant that using our Site, tools, or AI-generated content will result in a successful bid, tender award, or contract. All final tender documents, pricing, and compliance submissions remain your sole responsibility. Always verify tender details, closing dates, and requirements against the official issuing organ of state before submitting a bid.
4. Account Registration
Certain features (saving tenders, tender alerts, AI tools, document storage) require you to register for an account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.
5. Subscriptions and Payments
Some features are offered under paid subscription plans, billed via our third-party payment processor, Paystack. Subscription fees are charged in South African Rand (ZAR) and are non-refundable except where required by South African consumer protection law. You may cancel your subscription at any time; access to premium features continues until the end of the current billing period.
6. AI-Generated Content
Our AI tools (Tender Writer, Company Profile Builder, Tender Analyser, B-BBEE Advisor, Compliance Checker) generate draft content and guidance based on the information you provide. AI-generated output may contain errors or omissions and does not constitute legal, financial, or professional advice. You are responsible for reviewing, verifying, and editing any AI-generated content before relying on it or submitting it as part of a tender.
7. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorised access to our systems, accounts, or data
- Scrape, copy, or redistribute our tender database or content at scale without permission
- Upload malicious code or interfere with the operation of the Site
- Impersonate another person or misrepresent your affiliation with any entity
8. Intellectual Property
The Site's design, branding, original guides, and software are owned by TenderForce and protected by South African copyright and trademark law. Tender listings originate from public government sources and remain the property of the respective issuing organs of state. You may not reproduce or redistribute our original content without written permission.
9. Third-Party Services
The Site integrates third-party services including Supabase (data hosting), Paystack (payments), Resend (email delivery), and Google AdSense (advertising). Your use of these integrated services is also subject to each provider's own terms and privacy policies.
10. Limitation of Liability
To the maximum extent permitted by South African law, TenderForce shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, including but not limited to lost tender opportunities, lost profits, or reliance on tender information that has since changed or closed. The Site is provided "as is" without warranties of any kind.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Provisions relating to intellectual property and limitation of liability survive termination.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the South African courts.
