Who must comply? Employers with 50 or more employees, or employers below 50 employees but with annual turnover above the threshold in Schedule 4 of the EE Act, must submit Employment Equity reports annually to the Department of Employment and Labour. Note: EAP (Economically Active Population) targets are based on Statistics South Africa data. Designated groups under the EE Act 55 of 1998 include Black (African, Coloured, Indian) people and women. Employers with 50+ employees must submit annual EE reports to the Department of Employment and Labour.
EE Reporting Requirements
- Annual EEA2 and EEA4 forms to Labour Department
- 5-year Employment Equity Plan (EEA13)
- Display EE report summary (EEA2) in workplace
- Appoint a senior manager as EE Manager
- Consult with workforce forum or trade union
Impact on Tenders
EE compliance is assessed under the Employment Equity element of the B-BBEE scorecard (People Development and Employment). Poor EE compliance can reduce your B-BBEE level and cost you valuable preference points on government tenders. Some large contracts require an EE certificate or EE plan as a submission requirement.
